This section applies to information we process under the California Consumer Privacy Act (“CCPA”) or the Virginia Consumer Data Protection Act (“VCDPA”) and applies solely to consumers who reside in California and Virginia. If you are a resident of these states, you have certain rights with respect to that information.
This section does not apply to Pocket Gems’ personnel or job applicants that are residents of California. If you are a California resident and apply for a job with us, please see our applicant privacy notice.
For California Residents
Notice at Collection. If you are a California resident, you have a right to receive notice of our practices, including how we collect, use, share, sell, and retain personal data. You can find those details by clicking on the above links.
1) DATA COLLECTION
The categories of personal data we have collected in the preceding 12 months, and the sources of said data, are described in the section “Information We Collect” section of our Privacy Policy.
2) DATA USE
The business or commercial purposes for collecting your personal data are described in the “Use of Information We Collect” section of our Privacy Policy.
3) DATA DISCLOSURE AND/OR SALE
We do not “sell” your personal data in the way that most people would understand “sell.” We may, however, share your cookie information and advertising identifiers with our third-party advertising platforms to deliver interest-based advertisements, attribute installs, and optimize campaign performance. To the extent that activity is considered a “sale” under the CCPA, you may opt out of such activity by following the steps described in our Opt-Out Page.
We do not have actual knowledge of any sale of personal data of minors under 16 years of age, as the term “sale” is defined under the CCPA.
In the preceding 12 months, we have disclosed the following categories of personal data as part of our Services:

In addition to the disclosures described above, we may share any information we collect about you with our affiliates, to protect us or others, or in the event of a merger, sale, or other asset transfer. For more information, please see the “Disclosure of Your Information” in our Privacy Policy.
4) YOUR RIGHTS
Below are rights that are specific to California Residents. California residents also have additional rights as described in the California and Virginia Rights section below.
Do not Sell or Share My Personal Information/Right to opt out. You have the right to opt out from future “sales” or “sharing” of personal information as those terms are defined by the CCPA. For information on how to do so, please review our Opt-Out Page.
Please note that we do not knowingly sell the personal information of minors under 16 years of age.
Right to Limit Use and Disclosure of Sensitive Personal Information. You have a right to limit our use of sensitive personal information for any purposes other than to provide the services or goods you request or as otherwise permitted by law. However, please note that we do not collect or use sensitive personal information for any such additional purposes.
You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
Finally, you have a right to not be discriminated against for exercising these rights set out in the CCPA.
California residents under the age of 18. California residents under the age of 18 who are registered users of online sites, services, or applications have a right to remove, or request and obtain removal of, content or information they have publicly posted (subject to our verification of your identity and a number of exceptions). To request to remove content or information you have publicly posted, email us at privacy@pocketgems.com.
Retention of Personal Information. We generally retain personal information for two months or as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.
California Shine the Light. California Residents who have an established business relationship with us may choose to opt out of the disclosure of certain personal information about them to third parties for such third parties’ direct marketing purposes. As detailed above, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. If you choose to opt-out at any time after granting approval, please email us at privacy@pocketgems.com.
For California and Virginia Residents
Right to know/access. You have a right to request that we disclose what personal information we collect, use, disclose, and sell about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. Much of the information about categories of information is already included in this Policy. You may make such a “request to know” by contacting us at privacy@pocketgems.com.
Right to request correction or deletion. You also have a right to request that we correct inaccurate personal information and that we delete personal information we have about you under certain circumstances, subject to exceptions. You can make a request to correct or delete by contacting us at privacy@pocketgems.com.
Further, to provide or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account.
Right to opt-out of targeted advertising (Virginia residents). To opt-out from or otherwise control targeted advertising, you have several options:
- You can utilize any of the options in our Cookie Policy and on our Opt-Out Page.
- You can use the Global Privacy Control setting in a web browser or browser extension as described below.
These choices are specific to the device or browser you are using. If you access our services from other devices or browsers, take these actions from those systems to ensure your choices apply to the data collected when you use those systems.
Finally, you have a right to not be discriminated against for exercising these rights set out in these disclosures.
